Nautiqa Terms and Conditions of Use

1. Introduction
These Terms and Conditions ("Terms") govern your use of the Nautiqa website (www.nautiqa.com), including browsing, registering, and purchasing fishing tackle, marine gear, and related products offered by independent vendors. By accessing or using Nautiqa, you accept these Terms, our Privacy Policy, and all referenced policies. If you do not agree, please do not use the website.
These Terms comply with the laws of the State of Qatar, including the Qatar Consumer Protection Law No. 8 of 2008 and applicable e-commerce regulations.
2. Definitions
- "Nautiqa", "we", "us", "our" means Nautiqa LLC, the operator of the Nautiqa platform, a company registered in Qatar.
- "Platform" refers to the Nautiqa website, mobile applications, and related services.
- "Vendor", "seller" means any independent merchant authorized to list and sell products on Nautiqa.
- "You", "user", "customer" means any person visiting, registering, or purchasing through Nautiqa.
- Products" means fishing tackle, marine equipment, boating accessories, and related items listed on the platform.
- "Order" means your request to purchase specific products from a vendor.
- "Business Days" means Sunday through Thursday, excluding Qatar public holidays.
- "QAR" means Qatari Riyals, the primary currency for transactions on Nautiqa.
3. Platform Type and Role of Nautiqa
3.1 Marketplace Model
Nautiqa operates as an online multivendor marketplace connecting customers with independent vendors specializing in fishing and marine products. Vendors independently list, price, describe, and manage their inventory.
3.2 Nautiqa's Role
We provide:
- Technical platform and hosting services
- Payment processing facilitation through approved gateways
- Coordination and management of all shipping, logistics, and delivery through professional third-party delivery partners
- Customer service support for platform-related and delivery issues
- Basic vendor verification and monitoring
- Dispute resolution assistance
We do not:
- Take ownership of vendor products
- Set product prices or terms (except platform and shipping fees)
- Manufacture, inspect, or warrant the physical products sold by vendors
- Assume responsibility for vendor manufacturing or product quality performance
3.3 Legal Relationship
Purchase contracts are formed directly between you and the relevant vendor. Nautiqa facilitates transactions but is not a party to the sale unless explicitly stated.
4. Registration and Account Use
4.1 Account Creation
- You may create an account using accurate, current, and complete information
- You must be at least 18 years old or the legal age for contracts in your jurisdiction
- Only one account per person is permitted
- Business accounts require additional verification documentation
4.2 Account Security
- You are responsible for all activity under your account
- Keep your password secure and do not share account credentials
- Notify us immediately of any unauthorized use
- We may suspend accounts for security reasons or Terms violations
4.3 Account Termination
We reserve the right to suspend or terminate accounts for:
- Violation of these Terms or applicable laws
- Fraudulent activity or misrepresentation
- Abuse of the platform or other users
- Extended account inactivity (12+ months)
5. Product Listings and Information
5.1 Centralized Product Catalog
Nautiqa maintains a centralized catalog for fishing and marine products. Product listings—including descriptions, specifications, and images—are created and uploaded to the platform by Nautiqa using the details provided by the vendors. Once a product is approved and added to the Nautiqa catalog, vendors can add that specific product to their individual storefront pages.
5.2 Vendor Responsibility
Although Nautiqa facilitates the creation of the public product listing, the vendor remains strictly responsible for:
- The accuracy, legality, and completeness of the product details and specifications they submit to Nautiqa.
- Ensuring the physical product exactly matches the catalog description.
- Ensuring the products comply with Qatar GSO standards and all applicable safety regulations.
5.3 Platform Monitoring
While Nautiqa relies on vendors for product information, we manage the platform catalog and may:
- Edit, modify, or standardize product descriptions for consistency across the website.
- Remove or decline to list products that violate laws, safety standards, or these Terms.
- Suspend vendors who provide false or misleading product information.
- Require additional documentation (such as authenticity certificates or safety data) for certain items.
5.4 Pricing and Availability
While the product details are centralized, each vendor manages their own commercial terms for the items on their page:
- All prices are displayed in Qatari Riyals (QAR) unless otherwise specified.
- Prices set by the vendor must include applicable taxes as required by law.
- Product availability is strictly subject to the vendor's actual on-hand inventory.
- Vendors retain the right to change their listing prices at any time prior to order confirmation.
6. Orders and Payments
- When you place an order, you submit an offer to purchase the selected product(s) from the Vendor. Orders are subject to Vendor acceptance, and you will receive confirmation via email.
- Payments are processed via third-party gateways per our separate Payment Processing Policy. All transactions must comply with Qatar’s e-commerce and consumer-protection regulations (Law No. 8 of 2008).
- Ensure your payment method is valid, Nautiqa is not liable for failed transactions.
7. Platform Assistance
Nautiqa assists with shipping and return disputes but final resolution depends on vendor cooperation and applicable law.

8. Prohibited Activities and Content
8.1 Prohibited User Activities
You may not:
- Use the platform for illegal activities
- Create multiple accounts to circumvent restrictions
- Attempt to hack, disrupt, or overload platform systems
- Post false reviews or manipulate vendor ratings
- Harass other users, vendors, or Nautiqa staff
- Use automated tools to scrape or copy website content
8.2 Prohibited Products
The following items are banned from Nautiqa:
- Illegal fishing equipment or weapons
- Stolen or counterfeit products
- Items requiring special licenses (unless properly documented)
- Products that violate Qatar import/export regulations
- Hazardous materials requiring special handling
8.3 Content Standards
All user-generated content (reviews, questions, etc.) must be:
- Truthful and based on actual experience
- Free from profanity or offensive language
- Relevant to the product or service
- Respectful of others' privacy and rights
8.4 Enforcement
Violations may result in:
- Content removal
- Account warnings or suspension
- Order cancellation
- Legal action where appropriate
9. Vendor Responsibilities and Compliance
9.1 Vendor Requirements
All vendors must:
- Maintain valid business registration in Qatar or approved jurisdictions
- Provide accurate product information and pricing
- Honor stated shipping and return policies
- Comply with all applicable laws and regulations
- Maintain adequate inventory or update availability promptly
9.2 Quality Standards
Vendors are expected to:
- Provide products that match descriptions and images
- Package items securely to prevent damage
- Respond to customer inquiries within 48 hours
- Address complaints and returns professionally
9.3 Vendor Monitoring
Nautiqa monitors vendor performance through:
- Customer feedback and ratings
- Order fulfillment metrics
- Compliance with platform policies
- Response times to customer service issues
9.4 Vendor Violations
Poor performance may result in:
- Account warnings
- Restricted selling privileges
- Account suspension or termination
- Removal from search results
10. Intellectual Property and Website Use
10.1 Nautiqa's Rights
The Nautiqa platform, including its design, software, logo, and proprietary features, is owned by Nautiqa or licensed from third parties. All content is protected by intellectual property laws.
10.2 Permitted Use
You may use the website solely for:
- Personal shopping and research
- Legitimate business purchasing
- Accessing your account and order information
10.3 Prohibited Use
You may not:
- Copy, reproduce, or distribute substantial portions of the website
- Use automated tools to scrape product data or prices
- Reverse engineer platform software or features
- Create derivative works based on Nautiqa's design
- Use the platform to compete directly with Nautiqa
10.4 User Content License
By posting reviews, photos, or other content, you grant Nautiqa a non-exclusive license to use, display, and distribute such content for platform operations and marketing purposes.
11. Limitation of Liability
11.1 Platform Disclaimer
Nautiqa provides the platform "as is" without warranties of any kind. We do not guarantee:
- Continuous platform availability
- Error-free operation
- Compatibility with all devices or browsers
- Accuracy of vendor-provided information
11.2 Vendor Transactions
As a marketplace facilitator, Nautiqa is not liable for:
- Product quality, safety, or legal compliance
- Vendor failure to deliver or fulfill orders
- Disputes between customers and vendors
- Vendor fraud or misrepresentation
11.3 Liability Limitations
To the maximum extent permitted by Qatar law:
- Our total liability for any claim related to the platform's operation or our services is limited to the total value of the specific transaction in dispute.
- We are not liable for any indirect, incidental, consequential, or punitive damages (including lost profits, data loss, or business interruption).
- Any claim or cause of action arising from your use of the platform must be brought within one (1) year of the date the claim arose
11.4 Consumer Rights Protection
Nothing in these Terms limits your statutory rights under Qatar Consumer Protection Law or other applicable consumer protection regulations.
12. Governing Law and Dispute Resolution
12.1 Applicable Law
These Terms are governed by the laws of the State of Qatar. All transactions on the platform are subject to Qatar's e-commerce and consumer protection regulations.
12.2 Dispute Resolution Process
For disputes arising from platform use:

13. Force Majeure
Neither party shall be liable for delays or failures in performance due to circumstances beyond reasonable control, including:
- Natural disasters or extreme weather
- Government actions or regulatory changes
- Technical failures or cyber attacks
- Transportation disruption
- Public health emergencies
During force majeure events, we will make reasonable efforts to minimize disruption and communicate with affected users.
14. Changes to These Terms
14.1 Modification Rights
Nautiqa may update these Terms periodically to reflect:
- Changes in applicable law
- New platform features or services
- Improved user protection measures
- Operational requirements
14.2 Notification Process
- Updated Terms will be posted on the website with the revision date
- Continued platform use after changes constitutes acceptance
